Why do you think Bin Laden was never officially charged for participation in 9/11?

The FBI said they have confession tapes for years and yet they never submitted them for authentication (which would be the first step towards formal charges). The US is also charging Khalid Sheik Mohammed as the “Mastermind of 9/11”. Why do you think that they’re charging him and they never charged Bin Laden?
